Terms of Service

These Terms of Service ("Terms") govern your use of the Community Workbook application at buildbettercommunity.com (the "Service"), operated by TribeROI LLC ("we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you don't agree, you may not use the Service.

Service Description

Community Workbook is a self-service educational platform that provides structured worksheets and frameworks for community building. The content is based on the book "Community-in-a-Box" by Mark Birch and includes real-world examples from the Enterprise Sales Forum (ESF).

This is not consulting. We do not provide personalized advice, consulting services, or guarantees about your community's success. The Service is purely educational and informational.

Account Requirements

To use the Service, you must:

• Create an individual account with a valid email address
• Provide accurate and complete information
• Maintain the security and confidentiality of your password
• Use the Service only for lawful purposes
• Not share your account with others or create multiple accounts

You are responsible for all activity that occurs under your account. Notify us immediately at legal@triberoi.com if you suspect unauthorized access.

Subscription and Payment

Free Tier

We offer a free tier with limited access to worksheets and features. Free tier access may be modified or discontinued at any time without notice.

Paid Subscriptions

Paid subscriptions provide full access to all tracks, worksheets, and premium features. By subscribing, you agree to:

• Pay the subscription fee at the interval you selected (monthly or annual)
• Automatic renewal unless you cancel before the renewal date
• Price changes with 30 days' advance notice
• No refunds for partial subscription periods

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access until that date, after which your account will revert to the free tier.

Refund Policy

We do not offer refunds for subscription fees except as required by law. If you believe you were charged in error, contact us within 7 days at legal@triberoi.com.

Your Content and Data

Ownership

You retain all rights to the content you create in your worksheets (your "Content"). We do not claim ownership of your responses, plans, or community strategies.

License to Us

You grant us a limited license to store, display, and transmit your Content solely to provide the Service. We may also use aggregated, anonymized data from worksheet responses to improve the Service and create general insights (e.g., "60% of users choose in-person events").

Sharing Your Work

You may freely share your completed worksheets publicly (social media, with team members, in presentations, etc.) provided you:

• Include attribution: "Created with Community-in-a-Box Workbook by Mark Birch"
• Do not misrepresent the source of the frameworks or teaching content
• Do not remove or obscure any credits or copyright notices

Prohibited Content

You may not use the Service to create, store, or share content that:

• Infringes on intellectual property rights
• Contains malware, viruses, or harmful code
• Violates any applicable law or regulation
• Promotes hate speech, violence, or discrimination
• Contains private information of others without consent

Intellectual Property

Our Content

The Service, including all teaching content, worksheet templates, frameworks, ESF examples, design, code, and branding, is owned by TribeROI LLC and protected by copyright, trademark, and other intellectual property laws.

Book Content

Content derived from "Community-in-a-Box" by Mark Birch is used with permission. The book is available at Amazon.

Limited License

We grant you a personal, non-exclusive, non-transferable license to access and use the Service for your own community planning purposes. You may not:

• Reproduce, modify, or create derivative works from the Service
• Reverse engineer, decompile, or extract source code
• Resell, redistribute, or sublicense access to the Service
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Service to build a competing product

Prohibited Uses

You may not:

• Use automated systems (bots, scrapers) to access the Service
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service's operation

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIBEROI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

Termination

By You

You may terminate your account at any time by deleting it through your account settings. Upon deletion, your personal information and worksheet data will be removed from our active systems as described in our Privacy Policy.

By Us

We may suspend or terminate your account at our sole discretion if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees
• Create risk or legal exposure for us or other users

We will provide reasonable notice before termination unless immediate termination is necessary to prevent harm or comply with legal requirements.

Third-Party Services and Links

The Service may contain links to third-party websites or services, including:

• TribeROI.com (our consulting and analytics platform)
• Amazon (for the Community-in-a-Box book)
• Community platforms and tools referenced in teaching content

We are not responsible for the content, privacy practices, or terms of these third-party services. Your use of third-party services is governed by their respective terms and policies.

Indemnification

You agree to indemnify, defend, and hold harmless TribeROI LLC, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service, (b) your Content, (c) your violation of these Terms, or (d) your violation of any rights of another party.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law principles.

Informal Resolution

Before filing a claim, you agree to contact us at legal@triberoi.com to attempt to resolve the dispute informally. We commit to working in good faith to reach a fair resolution.

Arbitration

If informal resolution fails, you agree that any dispute arising from these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in New Jersey, and judgment on the award may be entered in any court having jurisdiction.

Exception: Either party may seek injunctive relief in court to prevent actual or threatened infringement of intellectual property rights.

Class Action Waiver

You agree that disputes will be resolved on an individual basis. You waive any right to participate in a class action, class arbitration, or representative action against us.

Changes to These Terms

We may update these Terms from time to time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email or a prominent notice in the Service
• Provide at least 30 days' notice for material changes

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you don't agree to the changes, you must stop using the Service and delete your account.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TribeROI LLC regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
